An 18-year-old Eden Prairie man has been charged with third- and fifth-degree criminal sexual conduct following an alleged incident on March 29 in Eden Prairie, according to court documents.
Mark Thomas Derouin, a 2024 graduate of Eden Prairie High School, is accused of assaulting a female co-worker at his residence. The incident was reported to police on April 8. A summons has been issued for Derouin to appear in Hennepin County District Court. He is currently not in custody.
According to the criminal complaint filed Aug. 1, Derouin faces one count of third-degree criminal sexual conduct, involving penetration by coercion, and one count of fifth-degree criminal sexual conduct, involving nonconsensual penetration.
The victim contacted police on April 8 to report that she was sexually assaulted by Derouin on March 29. She identified Derouin as a co-worker she had known for a few months.
She reported that she and Derouin met and hung out at a park several blocks from his home, where they talked. They then went to his home and got in a hot tub. The victim reported that Derouin sexually assaulted her in the hot tub.
The victim and Derouin then went into the house. In Derouin’s bedroom, the victim stated that Derouin forcibly sexually assaulted her multiple times over an extended period. The assaults allegedly included a brief period in which Derouin choked the victim, continuing until Derouin allowed her to leave, charging documents stated.
The victim said she attempted to push Derouin away and told him to stop. She reported that Derouin said something to the effect of, “You don’t get to say no.”
On March 30, Derouin texted the victim several times and apologized for the incident, explaining that his behavior was related to stress involving an unidentified medical condition that required an MRI on April 1.
In a final text on April 1, the victim replied: “… I told you multiple times that I didn’t want to (have sex). I resisted against you so many times … I told you no so many times in so many ways and even gave excuses to try and get away … and you did not care.”
The victim went to Fairview Ridges Hospital in Burnsville and underwent a sexual assault exam on April 1.
Derouin’s first hearing in Hennepin County District Court is scheduled for Aug. 15.
If found guilty of third-degree criminal sexual conduct, Derouin could face a maximum sentence of 15 years in prison and/or a fine of up to $30,000. The fifth-degree charge carries a maximum sentence of two years in prison and/or a fine of $10,000.
