An Eden Prairie man pleaded guilty to felony fifth-degree criminal sexual conduct, admitting to engaging in nonconsensual sexual penetration during an incident last year.
Mark Thomas Derouin, 19, entered the plea on Feb. 4 in Hennepin County District Court. As part of the agreement, prosecutors dismissed a third-degree criminal sexual conduct charge. If Derouin successfully completes probation, the felony will be reduced to a misdemeanor.
His sentencing is scheduled for April 9 before Judge Hilary Caligiuri at the Hennepin County Government Center in Minneapolis.
Derouin remains out of custody while awaiting sentencing. Under the plea agreement, he will serve three years of probation and undergo a presentence investigation and a psychosexual evaluation. The deal includes a 90-day jail cap, with the judge determining whether Derouin will serve jail time, electronic home monitoring, or another alternative.
Derouin was charged on Aug. 1, 2024, after Eden Prairie police investigated a woman’s report that he sexually assaulted her at his home. According to the criminal complaint, she told police he assaulted her on March 29, 2024.
He pleaded not guilty on Jan. 23, 2025, and sought to suppress evidence from his phone and have the case dismissed for lack of probable cause. A judge denied those motions, and on Feb. 4, he changed his plea to guilty.
Following his plea, Judge Caligiuri ordered a presentence investigation and a psychosexual evaluation, which will be reviewed before sentencing.
If the judge accepts the plea agreement, Derouin will be sentenced accordingly. If the judge rejects it, he can withdraw his guilty plea and go to trial.
His attorney, Ryan Garry, who is listed as lead counsel, did not return a request for comment.
